Area of application

These general terms and conditions apply exclusively to contracts with Spezialitäten-Haus G. Schulteis GmbH.
Any other rules and regulations will only apply if we have expressly confirmed this in writing.
These rules and regulations also apply to future business relations, even if this has not been explicitly stipulated.

Delivery and shipping costs

1. Incoming orders are processed taking into account the operational and seasonal conditions. Spezialitäten-Haus G. Schulteis GmbH reserves the right to make slight changes to product ranges.
2. The minimum order value is € 10. There is a small surcharge of € 3 for orders under € 10.

4. Spezialitäten-Haus G. Schulteis GmbH normally sends orders through the German postal service DHL. We reserve the right to change our method of delivery.

Right of return

1. Goods can be returned not prepaid to Spezialitäten-Haus G. Schulteis GmbH within one month of receipt. The deadline for returning goods begins from receipt of the goods or invoice. The goods must be sent back within the return period. Edible goods that have already been opened are excluded from our returns policy.
2. The contract is legally valid when the time limit has expired or when payment has already been received.

Guarantee

1. Complaints and faults must be reported immediately in writing or by telephone to Spezialitäten-Haus G. Schulteis.
   Ph: +49 (0) 24 05 / 709 - 473.
2. Customers with valid claims will receive a replacement or refund to the value of the original purchase price at the choice of Spezialitäten-Haus G. Schulteis.
3. Customer claims for compensation due to non-performance or consequential damage are not included.
4. We are not liable for goods or consequential damage, if a third party tampers with the goods.

Prices and conditions of payment

1. The prices are calculated ex works Spezialitäten-Haus G. Schulteis and include VAT.
2. The valid Internet shop prices are those that were shown online at the time the order was placed.
3. Invoices must be paid within 10 days.
4. Sending cash or stamps is not permitted.
5. Spezialitäten-Haus G. Schulteis GmbH charges € 4 for cash on delivery.
6. In certain circumstances we reserve the right to demand advance payment or payment via credit card for delivery.

Customer’s default of acceptance

If a customer refuses to accept the goods, Spezialitäten-Haus G. Schulteis GmbH is entitled to withdraw from the contract or claim damage of incurred expenses because of non-performance, within a stipulated time period.

Withdrawal from contract

We are entitled to withdraw from the contract if it becomes impossible to fulfil the contract and deliver the goods, due to a force majeure or an event beyond our control. If we find that the customer may not be able to pay for the goods or we receive false information about a customer’s credit rating, we are entitled to withdraw from the contract immediately. The customer is entitled to withdraw from the contract if we do not deliver due to gross negligence or intent.
The customer can withdraw from the contract, if the delivery period cannot be kept within an appropriate extension period.

Data storage

We store and process personal and company data in compliance with the data protection laws. We use this data for our advertising purposes and for those of other parties. You can object to us using your data at any time by writing to us. We reserve the right to have this data checked by credit companies.

Applicable law

Only German law is valid.

Place of performance

The Spezialitäten-Haus G. Schulteis GmbH headquarters is the place of performance for all services on both sides of the contract.

Severability clause

Should individual regulations of these general terms and conditions be or become null and void, the other conditions still remain valid.
